Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of the EnduroCoach mobile application and related services ("App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Description of the App

EnduroCoach is a fitness coaching app that helps users create workout plans, review training guidance, track fitness progress, log nutrition information, and access premium coaching features. The App may use information you provide, optional Apple HealthKit data, and app activity to generate personalized recommendations.

3. Eligibility and Accounts

You must be at least 13 years old to use EnduroCoach. You are responsible for the accuracy of information you provide and for maintaining the security of your account and device.

4. Health and Fitness Disclaimer

EnduroCoach provides general fitness, nutrition, and wellness information only. The App is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services.

You should consult a qualified healthcare professional before starting a new exercise, diet, or wellness program, especially if you have a medical condition, injury, are pregnant, take medication, or have concerns about your health. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, chest pain, or other concerning symptoms.

5. Apple HealthKit

If you choose to connect Apple Health, the App may request permission to read fitness-related HealthKit data to generate personalized workout plans and fitness insights. HealthKit permissions are optional and can be changed in iOS Settings. HealthKit data is not used for advertising and is not sold.

6. Auto-Renewable Subscription Terms

One month. This is an auto-renewable monthly subscription.

Subscription price

The current subscription price is shown in the App before purchase and may vary by country or region. The expected UK price is £2.99 per month unless App Store pricing displays a different local price.

What Premium includes

• Premium AI coaching features.
• Personalized workout and training plan access.
• Adaptive fitness recommendations.
• Subscriber-only workout guidance and coaching tools.

Billing and renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your Apple ID account may be charged for renewal within 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings after purchase.
• Cancellation takes effect at the end of the current paid subscription period.
• If a free trial or introductory offer is provided, any unused portion may be forfeited when you purchase a subscription, where permitted by Apple policy.

Refunds

Purchases are handled by Apple. Refund requests are subject to Apple's policies and should be requested through Apple Support or reportaproblem.apple.com.

7. Apple Standard End User License Agreement

Your use of EnduroCoach is also subject to Apple's standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how information is collected, used, and protected.

9. Acceptable Use

You agree not to:

• Use the App for unlawful, harmful, fraudulent, or abusive purposes.
• Reverse engineer, decompile, modify, or attempt to extract source code from the App except where permitted by law.
• Interfere with app security, subscriptions, payment systems, or access controls.
• Share, resell, or misuse premium features or subscription access.
• Upload or submit content that infringes another person's rights or violates applicable law.

10. Intellectual Property

The App, including its design, branding, software, text, graphics, and other content, is owned by EnduroCoach or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of the App or its content.

11. Availability and Changes

We may update, modify, suspend, or discontinue parts of the App at any time. We may also update these Terms from time to time. Continued use of the App after changes become effective means you accept the updated Terms.

12. No Warranty

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

13. Limitation of Liability

To the maximum extent permitted by law, EnduroCoach is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for injuries, losses, or damages arising from your use of fitness, nutrition, or workout information provided by the App.

14. Termination

We may suspend or terminate access to the App if you violate these Terms, misuse the App, create risk for other users, or where required by law. You may stop using the App at any time.

15. Governing Law

These Terms are governed by the laws applicable in the country or region where the app provider is established, except where consumer protection laws require otherwise.
